Conditions of participation competition Instagram

§ 1 General and procedure of the competition

Participation in the competition of the Instagram fan page: fh.aachen (hereinafter referred to as "the organiser"), is only possible with the inclusion of these conditions of participation. The competition is not supported by Instagram and has no connection with Instagram.

The competition starts on 28.9.2023 and ends on 19.10.2023 at midnight. Participants can enter by subscribing to the FH Aachen Instagram channel, liking the 10,000-follower reel and tagging the person with whom they would like to take the balloon ride in a comment below the reel.
Comments that violate the Instagram guidelines, German law or copyright will be removed without notice. The participant is therefore excluded from winning.

§ 2 Conditions for participation

All natural persons with legal capacity and a minimum age of 14 years may participate. Employees of the organiser are excluded from participation. By entering, the entrant agrees that, in the event of winning, his/her name will be published via the Instagram comment function of the Instagram post or story or that he/she will be contacted by direct message. Participation is only possible within the deadline stated in the competition description. The legal process is excluded.

The participant also agrees that photos or videos may be taken during the balloon flight, which the organiser may use as part of its social media presence.

§ 3 Prize

All participants will be entered into a prize draw to win a hot air balloon flight for the winner and one accompanying person. The date of the flight will be agreed between the winner and the provider Montgolfiera. No change or cash payment of the prize will be made. The winner will be notified by us via the story link. The winner must contact us within 5 working days by email to: [email protected] or by direct message on Instagram to the channel fh.aachen with his/her contact details. If the winner does not contact us, the prize will be forfeited without compensation.

§ 4 Liability

Claims for damages against the organiser in connection with the competition are excluded - within the legally permissible limits - irrespective of the legal grounds, unless the organiser has intentionally or grossly negligently breached statutory obligations. Furthermore, the organiser is not liable for damages resulting from the impairment of the availability of the competition website in the event of technical malfunctions and force majeure events beyond the organiser's control, as well as attacks by third parties against the competition website. However, the Promoter will make every effort to ensure the reliability and operability of the competition website. Furthermore, the Promoter does not guarantee that the competition website will function properly on the respective participant's computer.

§ 5 Place of jurisdiction / applicable law and severability clause

Legal recourse is excluded. The laws of the Federal Republic of Germany shall apply exclusively. Should any of these conditions of participation be or become invalid, this shall not affect the validity of the remaining conditions of participation. These conditions of participation may be amended by the organiser at any time without separate notification.

§ 6 Selection procedure

The winners will be selected at random within 2 days of the end of the competition. Legal recourse is, of course, also excluded here.

§ 7 Data protection

Insofar as personal data of participants is collected, processed and used within the scope of the competition, this data will be collected, processed and used by the organiser exclusively for the purpose of conducting the competition and will be deleted after the competition has ended. No data will be passed on to third parties.
